Terms & Conditions, Cancellation & Privacy Policy
At Tidal Treasures Charters & Water Taxi, we are committed to delivering a seamless and exceptional experience. The following policies ensure clarity, fairness, and safety for all guests.
CANCELLATION & PRIVACY POLICY
Guest Cancellations
- Cancellations made 7 days or more prior to the scheduled departure time will receive a full refund, minus any non-refundable processing or third-party platform fees.
- Cancellations made 3–6 days prior to departure will receive a 50% refund.
- Cancellations made within 72 hours of the scheduled departure are non-refundable.
- No-shows or late arrivals resulting in shortened charter time are non-refundable.
Cancellation timeframes are calculated based on the scheduled departure time in the local time zone of the charter location.
Deposits, when required, are non-refundable unless the charter is canceled by Tidal Treasures Charters & Water Taxi.
Weather & Captain Cancellations
Charters operate rain or shine. Guest safety remains the highest priority.
The Captain reserves sole discretion to cancel, modify, delay, or shorten a charter due to unsafe weather conditions, mechanical concerns, sea state, fuel considerations, port restrictions, or other safety-related matters.
- If the Captain cancels prior to departure due to unsafe conditions or mechanical issues, guests may choose a full refund.
- Guests may alternatively reschedule at no additional charge, subject to availability.
Route, itinerary, and destination adjustments may be made at the Captain’s discretion for safety or operational reasons.
Tidal Treasures Charters & Water Taxi shall not be liable for cancellations, delays, or modifications caused by events beyond reasonable control, including but not limited to natural disasters, hurricanes, government restrictions, port closures, acts of God, or other force majeure events.
Rescheduling
- Guests may request one reschedule without penalty if done at least 72 hours prior to departure, subject to availability.
- Rescheduling within 72 hours will be treated as a late cancellation unless due to documented emergency circumstances at the sole discretion of Tidal Treasures.
Late Arrivals
Charters begin promptly at the scheduled departure time.
- Late arrivals will not extend the charter end time. No refunds or credits will be issued for unused time.
- Guests are required to arrive at least 15 minutes prior to departure.
TERMS & CONDITIONS
Booking & Payment
- A valid payment method is required to confirm all reservations.
- A deposit or full payment may be required at the time of booking.
- Prices are subject to change without notice until confirmed.
- Gratuity is not included unless otherwise stated.
Confirmation of your reservation constitutes acceptance of these Terms & Conditions and Cancellation Policy.
Guest Responsibilities
- Guests must follow all instructions provided by the Captain and crew at all times.
- Unsafe, disruptive, reckless, or intoxicated behavior may result in immediate termination of the charter without refund.
- Guests are responsible for their personal belongings.
- Guests are responsible for any damage caused to the vessel or equipment due to negligence or misuse.
- Excessive cleaning resulting from guest actions may result in additional fees.
Age, Health & Ability
- Children must be supervised by a responsible adult at all times.
- Guests should disclose any medical conditions, mobility limitations, or special needs prior to departure.
- Participation in water activities and vessel movement is voluntary and at the guest’s own risk.
Liability Waiver
All guests may be required to sign an additional waiver prior to boarding.
Tidal Treasures Charters & Water Taxi, including its owners, captains, crew, agents, and affiliates, shall not be held liable for personal injury, illness, loss, or damage to personal property except where required by law or resulting from gross negligence or willful misconduct.
Medical treatment, if required, is the responsibility of the guest.
Photography & Media
Tidal Treasures Charters & Water Taxi may capture photographs or video during charters for promotional and marketing purposes unless written notice is provided prior to departure requesting exclusion.
Group Liability Waiver
I certify that I am the primary booking guest and am authorized to agree to these Terms & Conditions, Cancellation Policy, and Liability Waiver on behalf of all members of my party, including minors.
I acknowledge that participation in a charter boat experience involves inherent risks, including but not limited to vessel movement, weather conditions, water activities, equipment use, slips and falls, and marine or wildlife interactions.
On behalf of myself and all members of my party, I voluntarily assume all risks and release and hold harmless Tidal Treasures Charters & Water Taxi, its owners, captains, crew, agents, and affiliates from any claims, injuries, losses, or damages arising from participation, except where prohibited by law or resulting from gross negligence or willful misconduct.
I agree that all guests in my party will follow the Captain’s safety instructions at all times.
